Terms and Conditions

  1. These terms and conditions apply to the sale of items from the assortment of Desaer Bart bvba - Halensebaan 47 - 3473 Waanrode - VAT 0875.379.369

    By placing an order, the customer accepts these terms and conditions. By submitting the order (in writing, by fax, e-mail, telephone, internet, etc.), the customer acknowledges having taken note of Desaer Bart bvba’s general terms and conditions of sale and also accepts them. The customer hereby confirms that they will not use their own terms and conditions of sale.

    These terms and conditions may only be deviated from by written agreement of both parties.

    If any of these Terms is, for any reason whatsoever, unlawful or unenforceable, the remaining provisions shall remain in force.

    The agreement is concluded in Dutch. The customer may not invoke the fact that they do not have sufficient command of the chosen language in order to claim the non-applicability of one or more terms and conditions.

  2. Delivery periods are provided for information purposes only and are therefore not binding unless expressly agreed otherwise. Delay in the execution of the order can never give rise to compensation or termination of the agreement.

  3. The buyer must immediately take receipt of and inspect the goods. Complaints are only valid if made by registered letter. Complaints not submitted within 8 days after delivery will no longer be accepted.

  4. Hidden defects may only give rise to compensation if they are reported by registered letter within 3 months after their discovery. However, the goods must not have been processed or treated.

  5. The delivered goods shall remain the property of the seller until full payment of the sale price, increased by costs and interest.

  6. The risk passes at the moment the goods leave our warehouses.

  7. Our invoices are payable within 30 days from the invoice date.

  8. In the event of non-payment on the due date of an invoice, it shall, by operation of law and without any notice of default being required, be increased by a fixed compensation clause of 10% with a minimum of EUR 50 and by default interest of 10% per year.

  9. In the event of a dispute, only the courts of the judicial district in which our company is established shall have jurisdiction, and Belgian law shall always apply
